These Terms of Use (“Terms”) govern your use of the Kaart iOS app, its share extension, and related services at kaartstudio.app (together, “Kaart”). By using Kaart, you agree to these Terms. If you do not agree, do not use Kaart.
What Kaart is
Kaart is a creative tool for making illustrative route maps, posters, images, and videos. It is not a navigation service, emergency service, surveying tool, or source of authoritative geographic information. Do not rely on Kaart for turn-by-turn directions, safety decisions, or situations where inaccurate map or route information could cause harm.
Who may use Kaart
You must be legally capable of agreeing to these Terms. If you use Kaart on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Your content
You retain ownership of the routes, names, photos, GPX files, designs, and other content you provide or create with Kaart (“Your Content”). You are responsible for Your Content and for having the rights and permissions needed to use, edit, and share it.
Kaart does not claim ownership of Your Content. You give us only the limited permission needed to process content when you request a network feature, such as resolving a shared link, exchanging a Strava token, or looking up a flight.
Third-party services and content
Kaart can work with services and data from Apple, Strava, Google, CARTO, OpenStreetMap, and others. Their terms may also apply to your use of those features. We do not control third-party services and are not responsible for their availability, accuracy, or conduct.
Map and route data may be incomplete, delayed, or inaccurate. Required attributions included in an export must not be removed when doing so would violate a provider’s license or terms.
Acceptable use
You agree not to:
- use Kaart in violation of law or another person’s rights;
- upload or share content you do not have permission to use;
- interfere with, overload, probe, or disrupt Kaart’s services;
- circumvent access, security, or rate-limit controls;
- reverse engineer Kaart except where applicable law expressly permits it; or
- use automated means to extract or scrape the service at scale.
App availability and changes
We may change, improve, suspend, or discontinue features. We aim to keep Kaart reliable, but we do not promise uninterrupted access, permanent compatibility with third-party services, or that every route or map result will be available. Keep copies of exports or source files that are important to you.
Purchases
If Kaart offers paid features, purchases and subscriptions made through Apple are billed and managed by Apple under the App Store terms. Product descriptions and prices shown at purchase apply. Unless the law requires otherwise, refunds are handled through Apple.
Intellectual property
Kaart, including its software, design, brand, and original materials, is protected by intellectual property laws. These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use Kaart as intended. They do not transfer ownership of Kaart to you.
Disclaimers
To the fullest extent permitted by law, Kaart is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions do not allow certain disclaimers, so some of these terms may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Kaart and its developer will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, or business, arising from your use of or inability to use Kaart. Where liability cannot be excluded, our total liability will not exceed the amount you paid for Kaart during the 12 months before the event giving rise to the claim.
Termination
You may stop using Kaart at any time. We may restrict access to network services if you materially violate these Terms or create risk or legal exposure. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, and limits on liability.
Changes to these Terms
We may revise these Terms. We will post the updated version here and change the date above. Continuing to use Kaart after revised Terms take effect means you accept them.
